Constitution (3rd reform, September 2016 - August 2018)


Preamble

We, the people of the LCRUA, write and approve this constitution in order to establish a place for the sharing of culture and the preservation of freedom.

Definitions:

    1. “resident”: A nation which is located within the LCRUA and not a member.
    2. “member”: A nation which has official membership in the LCRUA, but does not have to be located within the LCRUA.
    3. "legal representative": A nation functioning as lawyer, prosecutor or legal advisor.


Section I - Rights

Description: This section contains your rights and the laws on living together within the LCRUA. These are somewhat similar to The Universal Declaration of Human Rights.

    1. Every resident has to follow the laws of the LCRUA, but does not have its rights until it becomes a member.

      A. Every resident following our laws has the right to become a member. They can do so by sending a telegram to the current President.
      B. Every resident and member has to inform the government of any puppets they have in the LCRUA. Anyone who doesn't risks a ban.

    2. Every member is free to stay in the LCRUA, as well as to move to or from it.

    3. No member’s membership can be removed without a good reason, and they can ask at any time to be relieved from it.

    4. The LCRUA is open to everyone, whatever their political beliefs or opinion, as long as they are respectful and behave with dignity.

      A. Every member has the right to their own opinion and expression, to seek, receive and give information and ideas through any media and regardless of any frontiers.
      B. No member can be rewarded, punished or confronted based on their vote in official polls.
      C. No discrimination is allowed, including but not limited to discrimination based on age, sex, gender, sexual orientation, ethnicity, belief, background or status.
      D. Members and residents must be respectful towards others.

    5. All member nations are free and equal in dignity and rights.

      A. Members and residents must behave with respect and good manners when representing the LCRUA in other regions.
      B. All members are equal before our law and have, without any discrimination, equal protection of that law. All members have equal protection against discrimination and it’s causes.

    6. No member’s privacy or correspondence can be violated without good reason. False accusations or attacks upon a member’s honour and reputation are not allowed.

      A. Every member has the right to protection against such violations or attacks.
      B. Every member has the right to be helped by the Council when one of their rights described in this Constitution is violated.

    7. No member nation can be punished without good reason.

      A. Ever member accused of crossing our laws is presumed innocent until proven otherwise in a public trial according to our law.
      B. In a trial, every member has the right be heard by impartial and independent judges.
      C. Suppressing, ejecting, banning, banjecting or being reported to NS moderators are punishments, but not the only ones.
      D. No member can be treated poorly or without respect.
      E. Laws can’t be used retroactively.

    8. Every member nation has the right to liberty and security.

    9. Every member nation has the right to freedom of thought, conscience and religion.

    10. Every member nation has the right to freedom of peaceful assembly and association, as long as our laws allow that association. No member nation can be forced to belong to an association.

    11. Every member nation has access to any services the LCRUA offers.

    12. The will of our members is the basis of our democratic system.

      A. Members are able to express their will through genuine elections held by free voting procedures.
      B. Every member has can take part in the government of the LCRUA, directly or through freely chosen individuals or groups.

    13. Every member, as a member of our community, has the right to the security we offer in being a part of that community, and can use everything we offer for the free development of their personality. Every member has the right to freely engage in the cultural life of the community, to enjoy its fruits, and to share its culture.

    14. A member’s rights are only limited to protect the rights of others, and to allow for a functioning and just system where they are able to live and thrive in.

    15. Each and every nation has the right to government transparency at all times.

      A. Each nation can request to know what the government is doing.
      B. Each nation is allowed to participate in government debates.



Section II - The Government

Description: This section defines the available positions in the LCRUA’s government, the responsibilities of each position, and the rules the government is bound by.

    1. All internal discussion between Councillors must be preserved in accessible locations so that they can be referenced in the future.

    2. The LCRUA’s government is the Council, led by the President, and consists of five Councillors leading their own department(s).

      A. The President is responsible for the entire LCRUA, and has authority over all of the region’s functions; said authority manifests in the form of being able to remove unproductive councilors with reasonable suspicion and consensus of Council majority and being able to place direct orders upon the Council via telegram without the process of legislation.
      B. Each Councillor is responsible for completing the tasks assigned to them by the President.
      C. Every Councillor can assign someone as their Vice-Councillor, who takes over in their absence.
      D. Every Councillor can create and develop their own department(s) in the way they see fit, as long as any authority or responsibility they grant to others is part of theirs.
      E. Every councillor has access to the Polls, Embassies, Communication and Appearance regional controls. Only the President has access to Border Control.

    3. The President is responsible for assigning tasks to Councillors. Councillors should take initiative when they have no tasks. Tasks are not limited to the ones below, but these are the essential ones to keep the region running:

      A. Legislation must be updated according to changes, legislative polls must be held when proposals are available, and members must be investigated when accused of violating our laws.
      B. The RMB must be moderated, so that it is kept relatively decent.
      C. The public must be kept informed on whatever goes on in the LCRUA, through the use of regional telegrams and the INN.
      D. Embassies and diplomatic ties with other regions must be managed and maintained.Regional RP must be nurtured and regional culture promoted.
      E. The region must be kept internally cohesive, disputes must be resolved, and new members be welcomed.
      F. Offsite links and forums must be upheld and maintained.

    4. Security Officers have access to Border Control, and safeguard our region from hostile forces.

      A. Each Security Officer is appointed based on their nation's WA-status, endorsement count and/or influence in our region.
      B. A Security Officer keeps their role for life, or until their nation ceases to exist (whichever happens first).
      C. Security Officers watch for and report suspicious activity to the military.
      D. Security Officers may not use their authority during peace-time.
      E. Security Officers must ban and eject hostile forces during war-time.



Section III – The World Assembly

Description: These are the laws regarding the WA-Delegate and the endorsement-cap.

    1. The WA-Delegate:

      A. Promotes the region, its ideals and its best interests in the World Assembly and related fora.
      B. Can be replaced by the Council with at least three fourth of the votes in favour of their successor.
      C. If they cease to exist their replacement must be the Council’s number one priority at the time.

    2. Security Officers safeguard our region from hostile forces (Access to: Border Control):

      A. During wartime by banning and ejecting any hostile force.
      B. During peace time by verifying that the WA-rules are respected, warning the WA-nation members who haven’t endorsed the WA-delegate and the Security Officers to do so, asking the last WA-nation(s) to have endorsed members other than the WA-delegate or Security Officers to withdraw their endorsement when it represents an overpassing of the endorsement cap, and officially accusing those who would refuse in front of the Tribunal.
      C. They may not use their authority over Border Control in time of peace and shall be removed from their position and trialled if doing do.
      D. They are each appointed by the Council with at least two thirds of the votes in their favour, Councillors must base their vote on their nation’s WA-status, activity, endorsement count and/or influence in the region, as well as overall trustworthiness.
      E. A Security Officer keeps their position until their nation ceases to exist or until the Council decides to remove them from office by a two third vote in favour of their empeachment.

    3. The WA-Rules:

      A. Every WA-nation in the LCRUA must endorse its legal WA-Delegate and Security Officers.
      B. For the time of their mandate, the President must withdraw their endorsement from the Security Officers. If the President is not a WA nation, they must choose a WA nation in the Council, or if no Council member is a WA nation amongst the members, in order to be their Representative and fulfill this role for them.
      C. If the WA-delegate ceases to exist or is replaced by the Council the President must endorse -or summon their Representative to endorse- the Security Officer of their choice to serve as a WA-delegate until the transition to the newly elected WA-delegate is achieved.
      D. Members and residents may not endorse non-member residents.
      E. No member other than Security Officers and the WA-delegate are allowed to have more than 90% of a Security Officer's endorsements.

    4. The LCRUA declares itself a neutral region, the region cannot join any interregional organization dedicated to raiding or defending, raiding defined as the act of a group of nations from outside a region who move in and endorse each other, with the objective of taking the position of World Assembly Delegate, and defending as the act of nations by outside a region of moving in to prevent a successful raid, raid the raided region to give it back to its original owners, or otherwise disrupt raiders with the objective of weakening their ability to raid, and if an interregional organization the LCRUA is part of is deemed by LCRUA members to have become a R/D organization, they may vote in behalf of the region to withdraw from it. Any nation in the LCRUA is free to participate in raiding and defending as they please, as long as it does not harm the LCRUA



Section IV - Elections

Description: This section describes how and when elections for each position are held.

    1. The President is elected by our members once every two months (at the end of January, March, May, July, September and November).

      A. Any Councillor can stand candidate.
      B. The President can only be in power for two terms in a row, after which they can’t stand candidate for a third.
      C. When leaving office, the former President becomes a normal Councillor.

    2. The Council is elected once every two months (at the end of February, April, June, August, October and December).

      A. Any member, except Judges, can stand candidate.
      B. All Councillors, except the President, have their seats up for election.

    3. The Tribunal is elected once every three months (at the beginning of January, April, July and October).

      A. Any member not part of our government can stand candidate.
      B. All Judges have their seats up for election.

    4. Election rules:

      A. Elections use simple plurality.
      B. When the result is indecisive, the duration of the election is extended.
      C. Elections are void if they break our law.
      D. A by-election is held when a position is vacant.



Section V – Polls and Proposals

Description: Here is defined how legislative proposals and official polls work.

    1. All official polls are made by a Councillor.

      A. All options must be clear and can't be inclined towards a personal opinion.
      B. The Councillor who made the poll must inform the region about it at it's start, and share the results with the region when closed.
      C. The result of an official poll defaults to simple plurality, unless stated otherwise in our law or the description of the poll itself.

    2. Each member has one vote, and every member has the right to vote in official polls.

      A. Voting is not compulsory.
      B. Members can vote once with either their main nation or one of their recognised puppets.
      C. Multiple votes by the same person are against our law, and all votes of that person are counted as blank.

    3. A legislative proposal can be made by any member.

      A. A proposal written or approved by the President can be polled.
      B. Proposals not approved by the President can be polled if more than 50% of the Council approves.
      C. Proposals not approved by the President or Council can be polled by referendum.

    4. Once a proposal has been approved, a poll is created by the Councillor for Legislation.

      A. The poll must include a link to the proposal, and must be named after the proposal.
      B. The options of the poll should include "Approve", "Reject", "Amend" and "Abstain", which are always the basic options of the poll.
      C. The 4 options are defined as follows:
        - APPROVE: the voter supports the proposal.
        - REJECT: the voter rejects the proposal.
        - AMEND: the voter shows they reject the proposal in it's current state.
        - ABSTAIN: the voter neither supports nor rejects the proposal.

      D. A proposal passes if more than 50% of all votes are FOR.
      E. Once polled, a proposal can’t be changed.



Section VI - Referendums

Description: You can find how to call for a referendum on a law or official here.

    1. Each member has the right to call for a referendum when they can prove at least 5 members support it.

      A. A referendum needs more than 50% votes FOR in it's poll to be successful.
      B. A referendum can change our law when there is a lack of government support.
      C. A referendum can remove a punishment from a punished nation.
      D. A referendum can remove a Judge from their position.
      E. A referendum can remove a Councillor from power.
      F. A referendum can force the President to step down (becoming a Councillor) or remove the President from power (both options must be present).



Section VII - Justice and Law

Description: The justice system, the Regional Security Council and regulations for our law are explained here.

    1. The Tribunal consists of 3 judges and presides over trials in the LCRUA.

      A. The Tribunal has the responsibility to decide on a just punishment in trials and resolve legal disputes.
      B. The chief judge is the candidate with the most votes, and serves a honorary role in court as the first speaker.

    2. Judges and legal representatives are capable in their field.

      A. New judges and legal representatives must pass an inauguration test before they take up their function. There is no limit on the amount of times a nation fails this test.
      B. All judges and legal representatives must attend classes on LCRUA Law at Luxford University.
      C. All judges and legal representatives will be tested at Luxford University occasionally. A judge or legal representatives may be temporarily suspended until they pass such tests.
      D. A qualified member must be present as professor of LCRUA law at Luxford University. They must provide quality classes regarding LCRUA law, be available for questions, maintain an up to date inauguration test and provide occasional tests.
      E. Nations who passed the inauguration test may submit ideas for classes or tests.

    3. Any resident of the LCRUA can accuse any other resident of violating our law if they have proof or valid suspicions, in which case a trial is held.

      A. The accuser is represented by a prosecutor, or can choose to represent themselves.
      B. The accused is represented by a lawyer, or can choose to represent themselves.
      C. The prosecution and defence get the chance to present their arguments to the Tribunal. The defence has the last word except for the judges.
      D. If the accused pleads not guilty, the Judges judge whether the accused is guilty or not based on proof presented by the prosecution.
      E. If applicable, the judges decide on a just punishment.
      F. The Security Officer(s) make sure any punishment is enacted.

    4. Every punishment can be repealed by a referendum.

    5. Any resident can ask the Tribunal to settle a legal dispute or irregularity in case our laws are not clear enough. The Tribunal can issue an official interpretation of disputed laws and can propose changes if necessary.

    6. The President and Security Officer are allowed to ban any resident(s) without trial to safeguard the region’s security.

    7. The Regional Security Council is the combination of Judges and Security Officers chaired by the Chief Judge.

      A. Proposals falling into the categories described by article 7 can be submitted to the RSC. The Chief Judge can reject proposals if there is a good reason.
      B. The RSC must be impartial and apolitical. The Security Council cannot act without good reason and solid evidence.
      C. Voting takes place on the LCRUA Forum under the RSC section.
      D. The RSC uses a clear majority vote. Draws are rejected. Any Judge or Security Officer can abstain from voting.
      E. RSC resolutions are implemented by the Council. The President can dispute a resolution.
      F. The RSC has the power to Condemn and Commend nations if they have good reason(s).

    8. Proposal categories accepted by the Regional Security Council:

      A. Commendation - Commends a nation for their efforts and accomplishments in the region.
      B. Condemnation - Condemns a nation for their actions against the region, all condemnations must be treated with the utmost seriousness.
      C. Punishment - Punishes a nation for their actions, the details are outlined in the proposal. All punishments must be treated with the utmost seriousness.
      D. Resolution - Describes legislation concerning the security of our region.
      E. Repeal - Repeals any previous security legislation.
      F. Present - the voter shows their activity but does not wish to affect the outcome of the vote. This option is not counted in the result.
      G. Commision - An investigation into a nation, region, organisation, party, election, ...

    9. This Constitution and addenda are the only legal legislation in the LCRUA. It applies within The LCRUA and to it's members.

      A. It can not be changed without public approval, with the exception for changes allowed by this Constitution.
      B. It can be changed to fix grammatical or styling errors, as well as to make it more readable, as long as it does not change the actual content.
      C. It must be worded in simple English where possible.



Section VIII - Regional Symbols

Description: Law related to our regional symbols and culture.

    1. The LCRUA has its own regional flag and regional emblem, which are symbols of the unitary alliance and are approved by law.

      A. The flag of The LCRUA is a vertical tricolor consisting of red, gold, and teal. In the center of this flag bears a black, grid globe, with 16 tiles of teal, gold, and red.
      B. The symbol in the center of the flag is our regional emblem.
