ARTICLE I
Constitution

§1. Preamble
The document here enclosed, by the authority of the Founder and People of Conch Kingdom, is established as the sole and indisputable legal code of the region and all her territories, and shall be acknowledged as such by all entities, present and future, foreign and domestic.

§2. Establishment of a government
1. The governing document of the region shall be known as the Lex Conchata. This document shall contain five Articles, the first of which details the foundation of the region and may not be altered once published. The latter four of these Articles shall contain a layout of the government's structure, a set of procedures for government actions, a code of laws, and a list of residents holding office, respectively.
i. The Prime Minister shall have the power to make corrections to the document after informing the current General Secretariat and Chancellor, as per this document.
2. The government of the region shall be known as the Constitutional Monarchy of Conch Kingdom. No other government operating within the borders of the region shall be recognized by this document.
3. Any governments holding prior claim to the rule of Conch Kingdom are hereby rendered without authority or legitimacy.

§3. Privileges held by residents
1. All residents are entitled to certain privileges, which take effect immediately upon their entry into the region, and expire upon their departure. No law shall be made to restrict these privileges, and the Constitutional Monarchy is responsible for their guarantee.
2. For these purposes, a resident is a unique human person in control of a nation existing within the borders of the region. No resident may control more than one such nation.
3. These privileges are as follows.
i. All residents may give, receive, withdraw, and otherwise exchange endorsements freely.
ii. All residents may vote in general elections held by the Constitutional Monarchy.
iii. All residents may contest the position of World Assembly Delegate at any time.
iv. All residents may express criticism of their government officials and each other without fear of repercussions for the act of criticism itself.
v. All residents may contest the position of any government office.

§4. Divisions of government
1. The region must possess an Executive Branch.
i. This branch shall contain a Founder, a World Assembly Delegate, and at least four Ministers.
ii. Members of the Executive Branch shall hold the responsibility of enforcing the laws of the region.
2. The region must possess a Legislative Branch
i. This branch shall contain a number of representatives elected from among residents, by all residents.
ii. Members of the Legislative Branch shall hold the responsibility of creating laws for the benefit of the region.


ARTICLE II
Government Structure

§1. Executive Branch
1. The region must possess a Founder, who may utilize the title of Monarch in formal settings. The Founder holds all powers available to their office, and may not be challenged or restricted in their authority.
2. The region must elect a Delegate to the World Assembly. The Delegate also holds all powers available to their office, and may not be denied these by any other official.
3. Four Senior Ministers are to be elected by the residents of the region. Ministerial positions created in future acts of law should be known as Junior Ministers.
i. A Minister of Foreign Affairs shall be responsible for negotiating with other regions, establishing relationships between Conch Kingdom and other regions and organizations, and speaking on behalf of the region in public fora. The Minister of Foreign Affairs, upon entering office, may set their own Embassy Policy at their own discretion. If this policy is not satisfactory to the Prime Minister, they may order the Minister of Foreign Affairs to change their policy. If they do not do this, this case will be taken to the Legislative Branch to be voted upon. If the Prime Minister has no objections, this Embassy Policy will immediately go into effect.
a. If a proposed Embassy Policy is taken to the Legislative Branch to be voted upon. This proposal will first be taken to Assembly of Nations to be voted on, if passed this proposal will continue to the Council, if passed again this Embassy Policy will immediately go into effect.
ii. A Minister of Domestic Affairs shall be responsible for communication between the Constitutional Monarchy and residents, facilitating elections, and managing recruitment and retention.
iii. A Minister of Cultural Affairs shall be responsible for planning events to take place within the region, managing cultural and entertainment programs for residents, and curating roleplay-related resources.
iv. A Prime Minister shall be responsible for serving as the region's Chief Executive, with the power to issue Executive Orders within the confines of this document; overseeing the duties of the three aforementioned Ministers and any additional Ministers added after the ratification of this document; and maintaining the regional code of law.

§2. Legislative structure
1. The region shall possess a legislature with the power to make additions and amendments to the code of laws. No other body or individual has this authority.
2. The legislature shall be known as Parliament, and divided into two chambers: an upper chamber known as the Council, and a lower chamber known as the Assembly of Nations.
3. The Council shall contain three seats, with one of these seats to be designated as the Chancellor by the Prime Minister, and tasked with the responsibility of leading Council debates and votes.
4. The Assembly shall contain a number of seats no greater than one thirtieth of the population at the time of election, with one of these seats to be designated as the General Secretariat by the Prime Minister, and tasked with the responsibility of leading Assembly debates and votes.
5. Elections for each seat in the Council shall be held every five months, while elections for each seat in the Assembly of Nations shall be held every three months.


ARTICLE III
Procedure

§1. Vacancies in government
1. Executive Branch
i. In the event that the office of the Delegate becomes vacant, the resident with the second most endorsements will take control of the position no more than twelve hours later.
ii. In the event that the office of any Senior Minister becomes vacant, the Prime Minister will choose a replacement that will serve until the end of that position's term. Should the office in question be that of the Prime Minister, the General Secretariat shall act as a stand-in until a new Prime Minister can be elected.
iii. In the event that the office of any Junior Minister becomes vacant, the Senior Minister above them will choose a replacement that will serve until the end of that position's term.
2. Legislative Branch
i. In the event that any seat in Parliament becomes vacant, a special election will be held and the winner of that election will serve out the remainder of the term.

§2. Executive Orders
1. All Executive Orders will be directed to the members Executive Branch and will have the force of law.
2. Any Executive Order may be overturned by a future Prime Minister, but will remain in effect until this is done.

§3. Treaties
1. All treaties will be negotiated by the Minister of Foreign Affairs or a designee and will be ratified by the Council.
2. Until the election of the Council, the Prime Minister will ratify all treaties.

§4. Passage of bills
1. Members of each chamber may propose bills to be debated on the floor of their respective chambers. During this time, bills may be modified or discarded. If a resident of the region has a bill to pass then they must send their proposal to a member of either chamber.
2. After a reasonable time has passed for debate, the presiding officer shall bring the bill to the floor for a vote.
3. If the bill originates in the Assembly and passes by a simple majority, it shall proceed to the Council, where it may be debated, but not modified or discarded.
i. Following this debate period, the Council shall vote on the bill.
ii. Should the bill pass with a simple majority, it shall become law.
iii. Should the bill fail to gather a simple majority, it shall be returned to the Assembly, where it may be modified or discarded.
4. If the bill originates in the Council and passes by a simple majority, it shall become law. Otherwise, it shall return to the Council floor.

§5. Amendments to the Lex Conchata
1. Any resident of the region can propose an amendment to the Lex Conchata at anytime.
2. For everyone who is not a member of Parliament, they must first be supported by singular member of Parliament for the amendment to being brought to the floor for a vote.
3. The amendment will be taken to the presiding officer of both chambers and will be put to the floor for debate.
4. After a reasonable time has passed for debate, the presiding officers shall bring the amendment to the floor for a vote.
5. For the amendment to pass it must receive a 2/3 vote in favor in both chambers.
6. If the amendment passes it will be the responsibility of the Prime Minister to make all proper changes to the Lex Conchata.

§6. Articles of Impeachment
1. At any time when a resident believes that an official has violated the Constitution or code of law, they may present a case to a member of Parliament.
2. If the member of Parliament approves of the case, they shall draw up Articles of Impeachment and submit them to the General Secretariat.
3. Each Article will contain a charge against the official and evidence to back up the charge. If the General Secretariat confirms that the Articles have been compiled properly, they shall submit it to the Assembly for a vote, where a three-fifths majority vote is required for passage.
4. If the Articles pass the Assembly, they will proceed to the Council for a trial. The Chancellor will take his or her seat as a Council member, and with the other Council members shall consider the Articles to determine whether the evidence proves guilt beyond a reasonable doubt. The Delegate shall preside over the trial and announce the verdict at its conclusion.
5. Should the defendant be found guilty, the Delegate shall enact consequences at their own discretion. If the defendant is the Delegate, their duties in this process shall be assumed by the Prime Minister.

§7. Enforcement of law
1. It is the duty of the Prime Minister to ensure that all laws passed by Parliament are enforced.
i. The Prime Minister can directly enforce any law when it deals with residents.
ii. The Prime Minister may delegate his authority to enforce laws to other Senior and Junior Ministers by an Executive Order.

§8. Elections
1. Campaigning for any elected position may start at any time after the completion of the last election for that position.
2. Campaigns cannot be declared after elections have started, unless no candidate is running.
3. In the case of a special election, each resident campaigning shall be allowed fourteen days to make their case in public before the start of the election.
4. Should any vacancy remain following an election, it shall be the responsibly of the Prime Ministers to appoint residents to each seat. Each choice must be confirmed by the Delegate.
5. Election shall be held in a consistent format.
i. All elections shall be held on the first of the month.
ii. Elections shall take place every three months for Senior Ministers and Representatives, and every five months for Council members.
iii. Polls shall be open to all residents, and shall remain open for seven days.

§9. Administrative Leave
1. Any official may request leave for any length of time through a telegram request to their direct superior.
2. If granted, a leave status excuses that official from all duties until the expiration of that leave.
3. If the absence, of the official extends past the end of their term, the official may be asked to resign from office.
4. If the Prime Minister believes having the official remain in office will result in negative consequences for the region and the official refuses to leave, the person will be force to resign.
5. While an official is on leave, the next most senior official will be responsible for completing all their duties and responsibilities.

C. 1.1.01

Anti-World Assembly Multiing

To prevent instability to the region that World Assembly Multiing will bring and to keep the eyes of the moderators of Nataionstates, this bill will empower the government to target those that commit World Assembly Multiing and bring a quick resolution to it.

1.World Assembly Multiing is defined as one person in control of two or more nations that two or more of those nations have a membership in the World Assembly.

2.This act makes World Assembly Multiing in Conch Kingdom and other regions illegal.

C. 1.1.02

Spam Act

To prevent conversation that is vulgar and/or inappropriate, this bill will empower the government to target those that post spam and bring a quick resolution to the it.

1. Spam is defined as irrelevant or inappropriate messages sent to recipients.
i. Gore, nudity, shock images, or highly R-rated text.
ii. Consecutive posts.
iii. Incoherent posts.
iv. Post with the intention to recruit.
v. Link to inappropriate websites.

2. This act makes the uses of spam illegal in the RMB, Discord, telegram, and any other forms of communication.

C. 1.1.03

Conch Security

To prevent instability to the region from espionage or treasonous act, this bill will empower the government to target those that commit espionage or treason and bring a quick resolution to the it.

1. This act will entail espionage, treason, classification of information concerning the government, falsely discrediting the government; Conch Kingdom; or regions we are bound by a treaty to defend.

i. Espionage is defined as the practice of spying or of using spies in the serves of a foreign region.

a. Joining Conch Kingdom or agreeing to act on behalf of a foreign region to gather classified information to give to a foreign region for malicious intent is illegal.
b. Knowingly providing false information to the government for the benefit of a foreign region is illegal.
c. Joining Conch Kingdom or agreeing to act on behalf of a foreign region to become the region’s World Assembly Delegate with the intent to overthrow the government, mass ejection of nations, or lock out the region for the benefit of a foreign region is illegal.
d. Joining Conch Kingdom or agreeing to act on behalf of a foreign region to gain access to the government to keep it from working as quickly as it can, closed embassies for no reason, to ruin the reputation of Conch Kingdom for the benefit of a foreign region is illegal.

ii. Treason is defined as the crime of betraying one's region, especially by attempting to kill the sovereign or overthrow the government.

a. Knowingly giving classified information to a foreign region with malicious intent is illegal.
b. Knowingly aiding a spy from a different region to commit espionage is illegal.
c. Knowingly causing the failure of a military operation is illegal.
d. Knowingly becoming the World Assembly to overthrow the government, mass ejection of nation, or lock out the region is illegal.
e. Knowingly providing false information to the government with malicious intent is illegal.

iii. Classified of information is defined as material that the government of Conch Kingdom deems to be sensitive information that must be protected.

a. There are four different classifications from highest to lowest
1. Top Secret - material would cause "exceptionally grave damage" to regional security if made publicly available.
2. Secret - material would cause "serious damage" to regional security if it were publicly available.
3. Confidential - material would cause damage or be prejudicial to regional security if publicly available.
4. Restricted - material would cause "undesirable effects" if publicly available.

b. Any information that is in relation to any part of the government will first be classified under restricted unless other wise indicated by the Monarch or Prime Minister.

c. If someone wishes to use information that is classified they will need to first go through the Prime Minister to have that information declassified.

iv. Discredit is defined as to cause disbelief in the accuracy or authority of

a. The government, Conch Kingdom; or regions we are bound to by a treaty to defend.
1. This could be done by eroding the trust of authority by falsely claim of misuse of power, lying to members, espionage, treason, or treason.
2. This act does no limit the way trust can be eroding.

2. If evidence is brought forth to the World Assembly Delegate or Prime Minister of any violation of subsection i or ii, the Delegate shall enact consequences at their own discretion. If the person in question is the Delegate, this duty shall be assumed by the Prime Minister.

Ministerial Reform Act
To take some strain off the Senior Ministers; this act will create two new positions in the Conch Kingdom government. This act will also confirm authorities for Senior Ministers.

1. This act shall introduce two new positions to The Monarchy of Conch Kingdom. The positions are as follows:
i. Surveyor
ii. Diplomat
2. The aforementioned Junior Ministers' responsibilities are as follows:
i. A Surveyor will create original, interesting questions for the region, and posting them as polls on a regular basis. They will report to the Minister of Cultural Affairs. There may be more than one Surveyor, and they will have "Polls" authorities.
ii. A Diplomat will be a mediator and messenger between other regions, both within and out of the Augustin Alliance. They will report to the Minister of Foreign Affairs. There may be more than one Diplomat.
3. This act does not limit the Senior Minister's ability in delegating tasks to their Junior Ministers.
4. The Senior Ministers (The Prime Minister, the Minister of Domestic Affairs, the Minister of Cultural Affairs and the Minister of Foreign Affairs) will be given new authorities.
i. The Prime Minister will be granted "Appearance", "Border Control", "Communications", "Embassies", and "Polls" authorities.
ii. The Minister of Domestic Affairs will be granted "Appearance" and "Communications" authorities
iii. The Minister of Cultural Affairs will be granted "Communications" and "Polls" authorities
iv. The Minister of Foreign Affairs will be granted "Communications" and "Embassies" authorities

AN. 1.1.02

Order of Recruitment

Recognising the commitment of certain individuals to the continued growth of the region, this bill re-instates the Order of Recruitment.

a) Order of Recruitment
i. The Order of Recruitment shall consist of a medal, and a ribbon.
ii. Recipients shall be awarded the medal upon showing to the Prime Minister that they have sent out 1,000 recruitment telegrams.

-If any recipient receives the Order of Recruitment again, a small conch shell shall be placed upon the Ribbon, up to three shells. After which they will receive a new ribbon, repeating the process as necessary.



*Recipients of the Order of Recruitments given by the previous Conch Kingdom government under the Conch Code need not re-apply.

AN. 1.1.03

Order of Merit

In recognition of one's commitment to the growth, prosperity and further development of the region, and their distinguished service to the region, this bill re-instates the Order of Merit.

a) Order of Merit
i. The Order of Merit shall consist of a Medal, and a ribbon.
ii. Recipients for the Order of Merit shall be nominated by a head of a department, and then approved by the Prime Minister.
-Nominations by the Prime Minister shall be jointly approved by the Minister of Domestic Affairs, the Minister of Cultural Affairs, the Minister of Foreign Affairs and the World Assembly Delegate.
-In the event a head of a department is the nominee, approval shall be forwarded to a member of their department.

b) Criteria
i. In order to be awarded the Order of Merit, certain criteria must be met:
-Must currently reside in Conch Kingdom
-Must have resided within Conch Kingdom for no less than two consecutive months at the time of nomination.
-Have distinguished service and outstanding achievements above and beyond the rest of the region, such as a clear devotion to the region, extremely high amounts of recruitment telegrams sent, and extremely meritorious conduct.
-Have actively and consistently helped to promote activity within the region, through the organization and promotion of games, roleplaying, or other events.

c) The Medal and Ribbons

C. 6.3.01

Line of Succession

To prevent instability to the region from the sudden loss of the Prime Minister and other members of the government at once, a line of succession should be established

1. This act will entail the line of succession of the government to insure its continued stability after a loss of the Prime Minister and other members of the government at once.

i. Succession is defined as the action or process of inheriting an office.

a. In accordance with Article 3 section 1 Subsection 1 subsection 2 the General Secretariat shall act as a stand-in until a new Prime Minister can be elected to which this law will not change.

b. In the instance that the General Secretariat does not act in accordance of Article 3 section 1 subsection 1 sub subsection 2 the line of succession will be as fallowed:

1. General Secretariat
2. Chancellor
3. Minister of Foreign Affairs
4. Minister of Domestic Affairs
5. Minister of Cultural Affairs
6. World Delegate

Foreign Interference

To prevent instability within the region through interference by foreign officials or residents through lobbying

1. This act will define actions taken by a foreign officials or residents that are trying influence the executive or legislative branches of government through lobbying.

i. Foreign interference is defined as a member of another region attempting to influence a
policy or vote.

ii. Lobbying is defined as seeking to influence a government official on an issue.

a. Foreign interference by an official or resident to influence a member of Conch Kingdom Parliament to create, change, and abolish a law with malicious intent is illegal.

b.Foreign interference by an official or resident to influence an executive member create, change, and abolish a policy with malicious intent is illegal.

2. If evidence is brought forth to the World Assembly Delegate or Prime Minister of any violation of subsection 1 the Minister of Foreign Affairs shall enact consequences at their own discretion.
