Constitution of the Aurora Union

Third Draft, Ratified

Preamble

We, the Sovereign Nations of the Aurora Union, united under one banner, secure our Rights and Freedoms, uphold Democracy, and govern in the interests of the Member Nations, and hereby adopt this Constitution as the supreme law of the region.

Article I - Fundamental Foundations

Section 1: Declaration of Supremacy

1. Only the rules of NationStates shall supersede this Constitution in governing the Aurora Union and its member nations.

Section 2: Definitions

1. Citizen- a member nation that qualifies for and has completed the requirements for citizenship.

2. Member nation- any nation with residency and/or citizenship in the Aurora Union; it may be used instead of 'citizens' if citizenship status is not applicable to a given clause.

3. Puppet- any other nation owned by a single user that is residing within the jurisdiction of the Aurora Union, excluding their main member nation chosen to represent them within the region, regardless of the number of nations controlled outside the AU.

Section 3: Admission

1. Every nation is freely admitted to enter and reside within the Aurora Union.

Section 4: Citizenship

1. Member nations may obtain citizenship within the Aurora Union if they (a) are not a puppet, according to the meaning defined by this Constitution; (b) have filled out and submitted the Aurora Union Citizen Application to Aurora u; and (c) have resided in the Aurora Union for three days.

2. Citizens of the region may (a) vote in elections; (b) run in elections; and (c) be appointed for government positions.

3. Puppet nations, as previously defined, may enter the region and maintain residency; however, they cannot gain citizenship and may not (a) hold any office within the regional government of the Aurora Union, and (b) be involved in any process of a democratic election for said government.

Section 5: Rights of Member Nations

1. All nations residing within the region shall be entitled to the Freedom of Speech and the Freedom to Act and Associate, in compliance with the rules of NationStates and the laws of the Aurora Union set forth by this Constitution.

Section 6: World Assembly Members

1. A nation that is a member of the World Assembly must endorse the Premier. An exemption may be granted by Congress on a case-by-case basis with valid reason.

Article II - Regional Government

Section 1: Regional Government Structure

1. The distribution of Powers in the regional government of the Aurora Union shall be as follows: (a) executive, (b) legislative, and (c) judicial.

2. The Executive branch consists of (a) the Founder, (b) the Premier, (c) members of the Premier’s cabinet, and (d) the Deputy Premier.

3. The Legislative branch consists of members of the Aurora Union Congress.

4. The Judicial branch consists of members of the Judicial Committee.

Section 2: Founder

1. The nation of Aurora u is the founder and head of the Union, with supreme executive authority.

2. The Founder's term is unlimited; it cannot be impeached, removed or expelled from the region.

3. The Founder may use its executive authority to block any attempt by the Premier or a member of Congress to amend or suspend this Constitution by unilateral decree.

4. The Founder shall have power over Executive, Appearance, Polls, Communications, Embassies, and Border Control.

5. The Founder must use its executive authority to counter any foreign aggression meant to invade, raid, or destabilize the region. Under what the Founder may believe to be an immediate threat, authority may be used by the Founder without prior authorization from the Premier.

6. In the case that executive authority is used without authorization in any application, the Founder must provide a statement to the Premier regarding the purpose and, if applicable, duration of any measures taken. The Premier may mandate that the Founder reverse the action(s) taken.

Section 3: Premier

1. The Premier shall serve as the head of government and World Assembly Delegate.

2. The Premier will be elected by a majority vote to a six month term.

3. The Premier must be endorsed by all WA members residing in the region. An exemption may be granted by Congress on a case-by-case basis with valid reason.

4. The Premier shall have power over Executive, World Assembly, Appearance, Polls, Communications, and Embassies.

5. The Premier shall be empowered to appoint a Cabinet, subject to the approval of Congress.

6. The Cabinet shall be as follows: Minister of Internal Affairs, Minister of Foreign Affairs.

    a. The Minister of Internal Affairs shall have power over Appearance, Polls, Communications, and Border Control.

    b. The Minister of Foreign Affairs shall have power over Appearance, Polls, Communications, and Embassies.

7. In the absence of the Founder, the Premier shall immediately assume its role and responsibilities.

Section 4: Deputy Premier

1. The WA Delegate shall be appointed by the Premier.

2. The Premier will serve as the tie breaker vote in Congress and will stand in for the Premier when needed.

3. The Deputy Premier shall have power over Appearance, Polls, and Communications.

4. Should the Premier resign, cease to exist, or otherwise leave office, the Deputy Premier shall fill the vacancy and assume the responsibilities for the remainder of the term.

Section 5: Congress

1. All legislative powers herein shall be entrusted to the Aurora Union Congress (AUC).

2. AUC members will be able to adopt by-laws for the region on any matters not explicitly reserved to and in this Constitution. All by-laws require a majority vote to pass.

3. Members of the AUC will be elected by a majority vote to a five month term.

4. To be eligible to run for the AUC, a nation must satisfy the requirements for citizenship.

5. Members of the AUC shall have power over Polls and Communications.

Section 6: Judicial Committee

1. All disputes pertaining to the wording, interpretation, meaning or intent of the Constitution, or any by-law, shall be referred to a Judicial Committee.

2. Members of the committee shall be nominated by the Premier, and confirmed by the AUC by majority vote. The AUC may pass by-laws to further regulate this matter, including but not limited to, terms of office, membership and composition, and any further powers and duties.

3. The AUC may vote, by majority, to accuse any state in the Aurora Union of violating the Constitution; such accusations shall be heard by the Judiciary Committee, which shall then vote to convict or acquit based on verifiable submitted evidence.

4. All accused parties shall have the right to review all evidence against them. Accused parties may plead their own case, or if so desired may choose a proxy to act on their behalf.

5. Penalties for violating the Constitution shall be regulated by the AUC.

Article III - Amendments to the Constitution

Section 1

1. All amendments to the Constitution must originate in Congress.

2. Any amendment may only be passed with a majority vote.

Article IV - Ratification

Section 1

1. The ratification of this Constitution by a majority of member nations of the Aurora Union shall be sufficient for its establishment as supreme law of the region.
