Case Overview

Background: During a vote over changing voting apparatus is Astoria, the Astra Regens Unike cast a vote in opposition to the bill, also formatting it in a large, bold, colorful way. Former Keeper of the Realms Omnicontrol took issue with this, and asked the court if it was legal, pointing to past examples of Astra Deus Astoreus abstaining on votes. The question posed was one of influence and conflict of interest, due to the fact that Angels may be more likely to vote one way if their ruler was, and the Astra Deus / Regens could just deny Divine Assent.

Ruling

The Archangel Tribunal ruled in a unanimous decision the following:

Voting, even if large and bold, is perfectly legal for the Astra Deus[a] / Regens to carry out, regardless of any impact it may have. For example, if I were to be made Astra Regens, and I voted in opposition to the bill, choosing the largest size, bolding, italicizing, and underlining my font, and making it in the most eye catching color I possibly could, this would be perfectly fine and allowed.


Reasoning

This ruling was a rather simple one to come to. In the Constitution of Astoria, it states in the very first section of the very first article that "All Spirits of Astoria shall have freedom of speech, [unless] the speaker spreads hateful ideologies, violates privacy, or incites general offense through their words." Voting, unless flaming is accompanied with it, does none of these things, additionally, the Constitution states in Article I, Section 6 that "All Angels of Astoria shall have the right to legislate and the legislative bodies of Astoria shall provide mechanisms to ensure Angel participation and input in the lawmaking process." Again, voting would, in the Tribunal's opinion, fall under this.

The second relevant evidence that we point to here is in Article III, Section 5 that "The Astra Deus's angelhood shall be perpetual, even if their nation leaves the Region or loses membership in the World Assembly." They are the ultimate Angel, so the rights that come with being an Angel should absolutely apply to them. Additionally, even if it were to be illegal, there is not much that could be done seeing as according to Article III, Section 4, "the Astra Deus shall enjoy
absolute immunity from civil, criminal and governmental prosecution." Therefore, the Astra Deus could not even be brought before the Tribunal to answer for illegally voting.

Finally, the Archangel Tribunal would like to state that this Tribunal is not to be used to settle petty political disputes. The only evidence given to rule in favor of the filing was precedent set by the Astra Deus, and impact that it could have. The Tribunal does not deal in probabilities. It does not deal in precedent. It deals in the Constitution. Denying an Angel the right to vote is against the Constitution, plain and simple, and this is quite clear to anyone who would bother to read the first section. The reason this case was filed, as it appears to us, is a petty dispute over a bill in the Angelic Assembly. That is not how the Tribunal is to be utilized.
