This proposal appears intended to replace the legacy resolution GA#323 No Penalty Without Law, which stood for over a decade and survived the destruction of this Assembly’s prior iteration. The purpose of this proposal is to prohibit ex post facto laws, laws created to punish activities which were not illegal when they were committed.

The proposal achieves this by requiring member nations to make their laws publicly available to their inhabitants and to provide avenues for legal remedy should their inhabitants be subjected to criminal punishment for crimes that were not illegal when they were committed.

By placing all the requirements on member nations, and allowing flexibility in how to achieve the dissemination of their laws, the proposal wisely adheres to the principles of national sovereignty desired by this Assembly, while still protecting the civil rights of citizens of member nations.
