Preamble

We the allied nations of Libertas, in order to promote the progress of our region, secure liberty for our region, and maintain the democracy of our region, declare and establish this document as the Constitution of Libertas.



Article I: Freedom of Expression
  1. The regional government possesses no authority over which decisions each individual nation selects on issues.

  2. The regional government possesses no authority to reprimand a nation for its political category.

  3. The regional government possesses no authority to dictate the classification, motto, currency, national animal, demonym, capital city, leader, religion, banners, or flag of a nation.

  4. The regional government possesses no authority to reprimand a nation for criticizing the government.

  5. Nations shall not be reprimanded for discussing topics of their own choosing within the Regional Message Board (RMB).

  6. Abusing the RMB is not tolerated. Abusing the RMB entails excessive spamming, and extreme or excessive rudeness.


Article II: Citizenship
  1. For a nation to become a Citizen of the Region, the nation in question must submit an application to the regional government.

  2. Every Citizen must disclose any puppet nations they possess to the regional government.

  3. Every Citizen must remain a World Assembly (WA) member in the Region at all times, unless specific exemption in granted by the regional government.

  4. The exact wording of the citizenship application will be decided by the regional government.


Article III: Freedom to Vote
  1. Only Citizen nations are granted the right to vote on regional legislation and other official regional matters.

  2. No vote is weighted more than any other vote. Every vote is equal.

  3. The duration of a vote must be established at the start of the vote. Once a vote has begun, there is no changing its duration.

  4. The regional government possesses no authority to dictate the vote of any nation.


Article IV: The President
  1. Establishes the office of the President.

  2. The President will serve as the Officer with the highest authority in the Region.

  3. The President is required to be the World Assembly Delegate of the Region.

  4. The President will serve to oversee all other offices of government.

  5. The President will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.

  6. The President is required to vote for or against World Assembly legislation in accordance with the popular vote amongst Libertas WA members. The President will vote according to the report of votes amongst Libertas residents that is present towards the bottom of all WA legislation voting pages.


Article V: Vice President
  1. Establishes the office of Vice President.

  2. The Vice President will be the second-in-command in the Region, after the President.

  3. The Vice President is first in the line of succession in the event of a vacant Presidential office.

  4. The Vice President will serve to assist the President in coordinating regional functions.

  5. The Vice President will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.


Article VI: Secretary of Foreign Affairs

  1. Establishes the office of Secretary of Foreign Affairs.

  2. The Secretary of Foreign Affairs will be the third-in-command in the Region.

  3. The Secretary of Foreign Affairs is second in the line of succession in the event of a vacant Presidential office.

  4. The Secretary of Foreign Affairs will serve to manage foreign relations with outside regions.

  5. The Secretary of Foreign Affairs will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.


Article VII: Secretary of Defense

  1. Establishes the office of Secretary of Defense.

  2. The Secretary of Defense will be the fourth-in-command in the Region.

  3. The Secretary of Defense is third in the line of succession in the event of a vacant Presidential office.

  4. The Secretary of Defense will serve to maintain regional security and command the Libertas military.

  5. The Secretary of Defense will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.


Article VIII: Secretary of Culture
  1. Establishes the office of Secretary of Culture.

  2. The Secretary of Culture will be the fifth-in-command in the Region.

  3. The Secretary of Culture is fourth in the line of succession in the event of a vacant Presidential office.

  4. The Secretary of Culture will serve to organize regional recreational activities, such as roleplay, contests, offsite games, etc.

  5. The Secretary of Culture will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.


Article IX: The Founder
  1. The Founder may not exercise their power except in the case of an immediate emergency, such as a military invasion against the Region.

  2. In the event of an immediate emergency, the Founder may only use their ability to eject/ban nations and to establish a regional password.


Article X: Endorsements
  1. Every WA member in the Region is required to endorse the President.

  2. Every WA member (with the exception of the President) is allowed to have a number of endorsements that is less than or equal to 1/3 the amount of endorsements the President possesses, rounded down.

  3. Every government Officer (with the exception of the President) is allowed to have a number of endorsements that is less than or equal to 1/2 the amount of endorsements the President possesses, rounded down.


Article XI: Supreme Court
    The peoples of Libertas, in order to better protect their liberties, and to ensure a fair and just judicial system do declare,
  1. There shall be a court of three citizens appointed.

  2. That this court shall be known as the Supreme Court of Libertas, which may be abbreviated as SCoL.

  3. That this court shall have supreme authority to judge criminal cases, interpret the Constitution and resolve legal disputes, including passing sentence upon any guilty parties.

  4. That this court shall have the right to set such procedures and rules as it deems necessary to conduct a trial.

  5. That the first Supreme Court of Libertas shall be appointed by a citizen vote lasting between two and five days, and following courts shall be selected by their predecessors and confirmed by an open vote requiring a quorum of voting nations to pass, that shall last between two and five days.

  6. That if a nominated nation not be confirmed, that the currently serving Court must nominate a different nation. If no acceptable nation is found within the first five candidates, the position shall be opened to a citizen vote. under the same conditions as the first court.

  7. That no member of the Supreme Court shall serve more than 12 consecutive months.

  8. That any citizen who wishes to be a member of the Court has the intention of serving at least one month.

  9. That no citizen may serve both as a member of the Supreme Court and an Officer of Libertas simultaneously.

  10. That no member of the Supreme Court may serve any role other than as a member of said Court in any legal matter, save if they are the accused.

  11. That if a member of the Supreme Court should be accused of a crime, the Vice-President of Libertas will stand as a replacement judge.

  12. That if a member of the Supreme Court does not respond to a trial within three days of a trial commencing, they shall be dismissed, and the highest ranking Officer excepting the President shall stand as a replacement Judge until such time as a permanent replacement is selected.


Article XII: Legislation
  1. For a proposed bill to become law, it must be voted in favor for by a majority of voting nations. The duration of this vote must be 2 to 5 days.

  2. Any Citizen may propose a bill to the regional government.

  3. Any law must not violate any Articles of this Constitution.


Article XIII: Freedom from Crime
  1. The regional government has the authority to impose sanctions against a nation that is in violation of this Constitution or any laws enacted by the regional government.

  2. Sanctions against a violating nation can include but, not limited too, ejection and banishment from the Region.

  3. The regional government must allow reasonable time for a violating nation to correct their violation before imposing sanctions against the nation in question.

  4. Any sanctions against a violating nation must be reasonable and not cruel.

  5. Treason, as defined by this regional government, is an action of inciting rebellion against the regional government.

  6. Any form of treason will result in immediate ejection and banishment from the Region.


Article XIV: Term Limits
  1. Each term for every office of government should last for around 5 months.

  2. An election for each office must begin within an appropriate time before the end of each term.

  3. Elections for all offices must last for 3 to 5 days.

  4. In order for a nation to hold any government office, that nation must be a Citizen of Libertas.

  5. An Officer can run for re-election an unlimited amount of times.

  6. No Officer can hold more than 1 office at a time (with exception given to section 10 of this Article). If an Officer is elected into another office, they must resign from their previous office immediately upon inauguration into their new office.

  7. In the event an election concludes as a tie, there will be a second election immediately after with a duration of 3 days. Only the tying nations will be on the ballot of the second election. If the second election also concludes as a tie, the President will decide the outcome. In the event both Presidential elections conclude as a tie, the next officer down the line of succession will determine the outcome.

  8. In the event of a vacant government office, the President will appoint an Interim Officer to fulfill the duties of the vacant office, until a proper election is conducted to fill the vacant office.

  9. In the event of a vacant Presidential Office, the next officer in the line of succession will become Interim President to fulfill the duties of the vacant Presidential office, until a proper election is conducted to fill the vacant Presidential office. An interim Vice President can be appointed to fulfil the duties of the subsequently vacant office.

  10. In the event of elections falling out of place with the regular election seasons, the President can adjust the term dates of current officers in order to realign them. Such a decision must be agreed upon by an Officer vote.


Article XV: Freedom from Inactivity
  1. In the event that an officer of this Region is inactive for over 1 week without providing proper notification to the Region, that Officer will be removed from their office. The officer who then is the highest on the chain-of-command is given the authority to appropriately administer an election to replace the inactive officer.

  2. In the event that the Founder ceases-to-exist, the regional government has authority to migrate the government to a brand new Region, created with an executive Founder, transferring all offices and assets of the regional government.


Article XVI: Amending the Constitution
  1. If the Citizens of this Region wish to amend the Constitution, the government Officers will conduct a vote amongst themselves. If a majority of the voting Officers vote to amend the Constitution with a proposed amendment, then a vote that is open to all Citizens will be conducted. The Constitution will be amended with the proposed amendment if a simple majority of voting nations vote in favor of the amendment.

  2. The Officer vote must be open for 1 to 3 days.

  3. The Citizen vote must be open for 3 to 5 days.


Article XVII: Democracy is Supreme
  1. This Constitution is supreme law of the Region. All government action and all legislation must completely comply with all Articles of this Constitution.

  2. For this Constitution to become supreme law of the Region, it must be voted into ratification by a majority of voting nations. Only WA nations may participate in the ratification vote of this Constitution. The ratification vote is required to have a duration within 5 to 7 days.

  8. In the event the Citizens of the Region wish to remove an Officer from office, the President will administer a vote open only to government Officers. This vote must be open for 1-3 days. If 3 officers vote to remove the Officer in question, then the President will administer a vote open to all Citizens. The Citizen vote must be open for 5-7 days. If 3/4 of voting nations vote to remove the officer in question, the Officer will be immediately removed upon the conclusion of that vote, ending the term for that office.

  9. In the event of a vacant Vice President, Secretary of Defense, or Secretary of Culture office, the President will appoint an Interim Officer to fulfill the duties of the vacant office, until a proper election is conducted to fill the vacant office.

  10. In the event of a vacant Presidential Office, the next officer in the line of succession will become Interim President (while still maintain their elected office) to fulfill the duties of the vacant Presidential office, until a proper election is conducted to fill the vacant Presidential office.

  1. Adds an Article titled 'Secretary of State'. This Article will become Article VI, shifting all Article numbers above VI up by I. The new Article VI will read as follows:

    1. Establishes the office of Secretary of State.

    2. The Secretary of State will be the third-in-command in the Region.

    3. The Secretary of State is second in the line of succession in the event of a vacant Presidential office.

    4. The Secretary of State will serve to manage foreign relations with outside regions.

    5. The Secretary of State will be elected by popular vote, which only Citizens may participate, as per Article III of this Constitution.

  2. Changes the Secretary of Defense Article so the SoD will be fourth-in-command of the region and third in the line of presidential succession.

  3. Changes the Secretary of Culture Article so the SoC will be fifth-in-command of the region and fourth in the line of presidential succession.

  4. Changes the Term Limits Article so Section 9 will apply in the event of all vacant non-president offices.

Presidential Impeachment
  1. Adds a Section to the Term Limits Article. This Section will become Section 9, shifting all sections in this Article with section numbers 9 and above up by 1. This new Section will read as follows:

    1. The President shall be impeached if at least 2 government Officers shall propose, or support a proposal by a citizen, for the impeachment of the President. If a proposal meets this requirement, the President shall be brought before the Citizens of Libertas in a hearing that shall be chaired by the Secretary of Defense. When all Citizens have had their questions answered, or when the Secretary of Defense deems it necessary, a Citizen vote shall be held to remove the President from Office. This vote must be open for 5 to 7 days. If at least two-thirds of voting Citizens vote in favor, the President shall be immediately removed from office.

  2. Changes the Term Limits Article so Section 8 will no longer apply in the event the Citizens want to remove the President from Office.
