Monarchy Alliance Consitution

Article One: Legislative Branch:
Three senators shall be elected every three months. They can propose any bill, except for decrelations of war, or treaties.

The requirements to be a senator are:
1. Be a citizen for two weeks
2. Never be convicted of treason or another high crime
3. Swear allegiance to the Emperor, His Majesty, Holy Roman Empires2, to the people of The Monarchy alliance before serving (oath of office)
4. Be on the TMA official discord

Term limits:
There are no direct term limits, however a Senator may only serve two consecutive terms, before for one term not serving.

Duties of the Senate:
1. Pass a budget for The Monarchy alliance every month.
2. Approve the emperors appointe for the Speaker of the house

Powers of the Senate:
1. Proposing bills (excluding decrelations of war, and peace treaties) with a majority vote, and his majesty, the Emperor Holy Roman Empires2 signature
2. Voting on Bill's
3. Approving on decrelations of war, or peace treaties.
4. Power to remove the: Minister of Foreign Affairs, Minister of Home Affairs, RP minister or Minister of Fun with a unanimous vote.
5. Power to remove a Justice with a unanimous vote.
6. Commending, or condemning regions (not war)
7. Overriding vetoes with a majority vote.

Footnote:
The budget of The Monarchy alliance may only be proposed by the Emperor, his majesty, Holy Roman Empires2.

Article Two: Executive Branch:
The executive branches sole leader is his majesty, the emperor Holy Roman Empires2. He may appoint the Home Secretary, Minister of Foreign Affairs, Ministe of Fun without the Senates approval, and for however long he wishes, unless they are impeached by the Senate.

Term limits:
His Majesty, the Emperor Holy Roman Empires2 serves for life, except for when he is on vacation, in which case he may temporarily grant executive power to another nation, foreign or domestic, of his choice.

Duties of the executive (the Emperor):
1. Protect the region from enemies, foreign or domestic.
2. Propose a budget for The Monarchy alliance.

Powers for the executive (the Emperor):
1. Appoint the Foreign Secretary, and be the sole decider in that decision

2. Appoint the Home Secretary, and be the sole decider in that decision

3. Appoint the minister of fun, and be the sole decider in that decision

4. Appoint the minister of rp, and be the sold decider in that decision.

5. Having the opportunity to sign veto senatorial bills (vetoes can be overturned).

6. Having to opportunity to serve an an appellate judge in cases if he chooses to accept the appeal of a defendant found guilty by the Jusitce.

National Emergency Clause:
His Majesty, Holy Roman Empires2 may declare a national emergency in a mass exodus, or any other time that he sees a national emergency fit. This power is to be used sparingly. In the case of a national emergency, the founder will take control of the region, and have broad powers, in a dire emergency.

Article Three: The Judicial Branch
The Judicial Branch will be composed of two justices, appointed by the Senate. The justices may not be senators.

1. The justice will oversee fair trials on all citizens who stand accused of crimes.

2. The justice has to provide a lawyer to the defendant accused.

3. The justice has to allow for the defendant to challenge every piece of evidence, and cross examine the prosecutions witness, as the defender and his lawyer so please.

4. The justice must find a ruling, as guilty, or not guilty, and provide a brief statement on his ruling, to be archived.

Justice Apoointment and Removal:
1. The Senate, with a majority vote, as to find a willing canadite for justice, and appoint him.

2. The Senate may remove a justice with a unanimous vote.

Trial process:
1. There will be a hearing on the case, where the defense may move for dismissal of the case, and the jusitce may either grant, the dismissal, ending the case immediately, or deny that.

2. In the hearing, the prosecution or defense may ask to recuse the justice, on counts of bias, conscious or unconscious, and then the emperor will decide whether the justice shall be recused. If the emperor decides that the justice cannot serve on the case, he shall take the role of justice.

(NOTE: Openings are optional for each side, and each side can choose weather to submit an opening for the trial.)

3. The prosecution will list, and then call its witnesses for the trial.

4. The defence will cross examine the prosecutions witnesses for the trial.

5. The defence will list, and then call its witnesses for the trial.

6. The prosecution will then cross examine the defences witnesses for the trial.

7. The prosecution will submit its evidence.

8. The defence will counter the evidence.

9. The defence will submit the evidence.

10. The prosecution will counter the evidence.

11. Both sides will submit closings.

12. The justice will give his/her ruling, and then release a short statement to be archived.

Appeallate Proecess:
1. A defendant found guilty by the jusitce can appeal to the emperor, and if he accepts, the trial process starts again, to be closely examined.

2. If the his majesty the Emperor, Holy Roman Empires2 served as the justice, he will appoint a temporary jusitce, whoever he sees as unbiased.

Those exempt from being tried for crimes:
His Majesty, Holy Roman Empires2

Article 4: Impeachment
1. Any goverment officials who the Senate has the power to impeach (see section 1), can be impeached with a unanimous Senate vote.

2. Govemerment officials who the Senate has the power to remove can be removed for the following crimes:
1. Treason, or other high crimes

Article 5: Citizenship:
1. Any citizen who is a member of the region, and discord for one week is a citizen, after applying and taken the oath of citizenship (see Oath of Citizenship Clause)
2. His Majesty, the Emperor Holy Roman Empires2 is automatically granted citizenship
3. A citizen of TMA may not have two nations with citizenship, and if so, will be barred from holding citizenship from 2-4 months again, and permanently after second of such an offence.
4. His Majesty, Holy Roman Empires2 can grant Honorary citizenship to any foreigners, who he feels have done a great service to TMA

Rights of citizens:
1. A right to a fair trial
2. The right to vote
3. The right to appeal (the appeal must still be accepted, but non-citizens have no right to appeal)
4. The right to free speech

Members clause:
Anyone not a citizen can be kicked from the region by His Majesty Holy Roman Empires2, without an explenstion, with a formal statement from his Majesty. If the Senate accepts the kick, then the member can be banned.

Oath of Citizenship Clause:
I (nation name) solemnly swear to serve His Majesty Holy Roman to and The Monarchy alliance to the best of my abilities.

Article Six: The Revision-Addition Clause
1. Every article, but article 2 (only with premission of the Emperor) may be revised, and and new articles not contradicting any new articles can be revised.

Article Seven: The Ministries
1. Establishes the ministry of foreign affairs headed by the minister of foreign affairs. The minister of foreign affairs can appoint as many ambassotors as he sees fit, propose/reject embassies, and draw up statements of other regions if need be.

2. Establishes the home office, which archives all laws, elections, judicial rulings, ext, and monitors the regional message board, and can supress. He also, by situation, can create, and disband a policy agency (not required).

3. Establises the minister of rp, which is in charge of roleplay.

4. Establishes the minister of fun, who creates various activities and contests at will.

Criminal Codex:
Treason: The highest crime, and if found guilty, the defendant found guilty must be banned immediately, and scratched out of any public records, besides their own trial. Defined as: Betraying his majesty the Emperor, and The Monarchy alliance. A high crime

Abuse of Power:
A goverment offical abusing his power to his own gain in office, and punishments range from revoking citizenship for 1 month, to six months. If that certain goverment officals abuse of power is especially heinous, a year of citizenship revocation can be the punishment. If it is organized (2 or more government officials are involved), and the abuse of power is heinous, citizenship can be revoked for life, or the government official banned for one month. A high crime

Bribery:
Any type of quid pro quo, minor violations can go off with not being able to vote in the next election (citizenship is intact), to four month citizenship revolution. A high crime

Harassment:
Attacking someone, such as inflammory posts, or name calling. In minor cases, a defendant may go off with a warning, and in severe cases, two month citizenship revocation. If it continues, a citizen may be banned. A serious crime, but if repeated to the extreme, it becomes a high crime

Spam:
Repeated messaging, after being wanted 3 times by a govemrnent offical. A warning, to not being able to participate in events and rp. If the spamming is so repeated (this is to be the extreme), a citizen can be ejected (temporarily) . This is to be the extreme. A petty crime

Repeated breaking of rp rules:
Anywhere from a warning, to being banned for one month in government sponsored rps (you can rp with a friend still.) A petty crime

Other minor violations:
If, case by case, a minor violation not listed here is broken, and the emperor agrees it should be prosecuted. Ranges anywhere from a warning, to banning in being in more than one rp. A petty crime.

Citizenship act in the Criminal Codex:
If someone has two citizen nations, they are to have their citizenship revoked for 6 months. 6 months is to be added for every additional citizen puppet.

Faicst clause:
Any proven fascist, including nazis can be immeaditly banned by the emperor or the home secretary. The emperor may reverse his, or the home secretaries decision. Whoever banned the fascist must provide a detailed written statement as to why they are banned.

Article Eight: Political Parties
Any citizen can create a political party
