Look, you can poke holes in that all you want- but the fact is, it's extremely hard to reason with you because you have a tendency to expect the worst out of most things IC. I understand seeking a failsafe in case things go wrong (it's already there as before), but a lot of your argument for an 'open' convention is based on the theory that a closed one might break down and fail at any given moment and then the region will be dead and softlocked. It's impossible, really, to argue against this because assuming the worst in any given situation means we'll never come to a conclusion; it's also not the way to get us out of a crisis. Ultimately, when it comes down to it, if the convention does die and people aren't willing to get new members, then the whole region is totally dead, and no amount of flip to any other form of convention will help anyone. There's a million different amendments we could make; none of them actually get us anywhere. The bill at hand is one that will get us somewhere so we should just vote for it & be done.

I would appreciate it, if you could at least respond to the other points I brought up as well, give those were equally pertinent.

I responded to what you said to me and I don't think it's unreasonable for me not to be expected to reply to all details of your conversation with another person involved. I also think that what I've said accurately sums up my position on this matter and I don't see the need to spend another 4 paragraphs saying the same thing; the members of this House can see my position fair enough. To be honest, I also don't really understand what you were saying to Cerdenia, there's in my opinion a lot of words but very little meaning.

Also, it's not fair debate that you attempt to combat me with "respond to the rest", when your entire response to my points is 'ok what about the rest that's equally pertinent' - you haven't even attempted to engage in debate with me there, so I don't think I should be expected to spend time writing paragraphs on things I've already broadly covered, when you haven't responded to me at all there.

Amends Article II, Section I to read as follows:
Section I - Establishes the Fifth Constitution of Thaecia, reading as follows;

    FIFTH CONSTITUTION OF THAECIA

  • ARTICLE I - Constitution

    • Section I - The power only to ensure the continuation of the region outside of the Constitutional Convention lies upon the Governor of Thaecia and the Leader of the Convention; typical components of a free and democratic society must not be interfered with. The Constitutional Convention is initially a Closed Convention.

    • Section II - The Electoral Commissioner is responsible for holding elections for the Constitutional Convention; they shall hold public instant-runoff voting elections for the Leader of the Convention; if the Electoral Commissioner persistently fails to run these elections, the Governor of Thaecia may replace them. While the Constitutional Convention is a Closed Convention, public single-transferable voting elections are to be held for the seven (7) members of the convention.

    • Section III - The Constitutional Convention, while a Closed Constitutional Convention, shall work in the following manner;

      • 1. The Leader of the Convention shall be responsible for organising debates and votes on any platform which is reasonable for most Thaecian citizens to access;

      • 2. Any citizen of Thaecia under the rules of the Fourth Constitution may submit Amendments to the Constitution, which may be rejected by the Leader of the Convention,

      • 3. The Members of the Convention may overrule a rejection of an amendment with a motion to do so, which must pass with a simple majority vote in favor,

      • 4. The Members of the Convention shall vote on any amendment, which require a 2/3rds majority to pass; if an amendment is passed, it shall then progress to a whole-citizens vote, which requires a 3/5ths majority to pass; all votes are public.

      • 5. Once the Members of the Convention are satisfied that they have passed the requisite amendments, the whole Constitution shall be voted on by the members, requiring the same majority as amendments, then progress to a whole-citizens vote, requiring the same majority as amendments; if this vote succeeds this whole Constitution shall be replaced by that text.

      • 6. Members of the Convention or the Convention leader may be removed by a petition signed by at least six (6) citizens & then approved via a region wide referendum by simple majority.

      • 7. Any vacancy in the Convention Leader must be replaced by special election.

      • 8. The Convention may, by two thirds supermajority vote in favor, turn itself into an Open Convention. Upon doing so, the Constitutional Convention is to become an Open Constitutional Convention. This may also occur two (2) weeks after the date of the initial election of the Convention Leader and Convention Members through a petition signed by at least six (6) citizens.

    • Section IV - The Constitutional Convention, while an Open Constitutional Convention, shall work in the following manner;

      • 1. The Leader of the Convention shall be responsible for organising debates and votes on any platform which is reasonable for most Thaecian citizens to access;

      • 2. Any citizen of Thaecia under the rules of the Fourth Constitution are members of the Convention,

      • 3. The Members of the Convention shall vote on any amendment, which require a 2/3rds majority to pass; all votes are public.

      • 4. Once the Constitutional Convention is satisfied that they have passed the requisite amendments, the whole Constitution shall be voted on by the members, requiring the same majority as amendments, then progress to a whole-citizens vote, requiring a two-thirds supermajority vote in favor to pass; if this vote succeeds this whole Constitution shall be replaced by that text.

      • 5. Any vacancy in the Convention Leader must be replaced by special election.

      • 7. The Convention may, by two thirds supermajority vote in favor, turn itself into a Closed Convention. Upon doing so, the Constitutional Convention is to become a Closed Constitutional Convention.

    • Section V - The Convention may not put the same draft of the whole Constitution to vote more than once.

    • Section VI - The Convention Leader will remain Convention Leader even if the Convention switches to an Open Constitution Convention or a Closed Constitutional Convention. Convention Members for a Closed Constitutional Convention do not retain their membership if the Constitutional Convention becomes a Closed Constitutional Convention again.

Amends to read,

    • 6. Any vacancy in the Members of the Convention or the Convention leader must be replaced by special election.

  • Section IV - Members of the Convention may vote to amend this Constitution; any amendment must be passed with a 2/3rds majority vote and then ratified by a 3/5ths majority vote of the citizenry of Thaecia.

Act in regards to Constitutional repeals and Conventions (2024)

Noting the complete lack of legal order and system in Thaecia at present.
Understanding a constitutional convention must be held outside of the regular legal system to restore Thaecia.
Pursuing the restoration of order and democracy in Thaecia, but recognising that Thaecia is under crisis and that attempts to do this with the current legal system are not realistic.
Determined that Thaecia will survive no matter what.
Thus convening a constitutional convention to navigate Thaecia through this crisis which poses to us an existential threat.

Hereby,

Section I - The passage of this bill constitutes the repeal of all Legislative Resolutions, excluding this bill itself, in regards to those passed through the methods stated in Article IV, Section IV, of the Fourth Constitution of Thaecia or similar sections in its predecessors; including but not limited to any laws mentioned in the dispatches established by Legislative Resolution 039 Law Registry Act (2020).
  • Sub-section I - The passage of this bill does not constitute the repeal of any other legislation passed through means other than the contents of that section of the Fourth Constitution and predecessors alone; no sub-sections apply, only the parent section itself.

Section II - The passage of this bill constitutes the repeal of the Fourth Constitution of Thaecia.
Section III - The passage of this bill constitutes the dissolution of the Thaecian government as an effect of the repeal of the Constitution of Thaecia as no positions will legally exist; the serving Electoral Commissioner, the World Assembly Delegate, and the Vice Delegate, are exempt from this.
Section IV - The passage of this bill constitutes the succession of the Thaecian government to the Governor of Thaecia and the Leader of the Convention once elected.
Section V - The contents of this legislation are only enforceable when passed with a 2/3rds majority in each Chamber of Congress and the approval of the citizenry with a 3/5ths majority vote in a referendum.
