Eminent Domain

The people have the right to enjoy their property and to feel safe and secure their without unnecessary interference. However, events and necessities sometimes occur which require swift and immediate action for the good of the public, unfortunately, in some instances, at the expense of said properties. Therefore, eminent domain shall be legal ONLY when ABSOLUTELY necessary for the good of the public. Such necessities shall include:

-Schools*

-Medical care facilities, including hospitals, veterinary clinics, doctors' offices, dentists' offices, and optometry**

-Fire Stations

-Police Stations

-Jails or prisons***

Before ANY property can be seized, with the exception of conviction of a crime, the owner of said property MUST be adequately compensated.

*Does not include community colleges, universities, or private schools.

**Does not include centers for non-essential procedures such as cosmetic surgery or lasik unless the center for NECESSARY care so chooses to include such procedures within the same facilities.

***Does not include private prisons.
