Regulation 183/2017 of 14 April 2017 concerning first set of sanctions against the Russian occupation of Central Asia by force
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof,
Having regard to Council Decision 2017/580/CFSP concerning the illegal occupation of Central Asia
Having regard to the joint proposal of the High Representative of the Union for Foreign Affairs and Security Policy and of the European Commission,
Having regard thatThe EU is Kazakhstan's biggest trade partner ever, with almost 40% share in its total external trade.
Whereas Russia's act of aggression in invading Central Asia is a violation of the sovereignty and territorial integrity of the country and is against international law and in breach of Russia's obligations as a signatory to the UN Charter, whereby it guaranteed to respect the territorial integrity and sovereignty of all nations;
whereas the arguments presented by the Russian leadership to support this aggression are utterly unfounded and out of touch with the realities on the ground
whereas strong international diplomatic action at all levels and a negotiated process are needed in order to de-escalate the situation, ease tensions, prevent the crisis from spiralling out of control and secure a peaceful outcome; whereas the EU must respond effectively so as to allow Central Asia to fully exercise its sovereignty and territorial integrity free from external pressure
Emphasises the need for the EU and its Member States to speak to Russia with one united voice and to support the right of Central Asia to determine its future freely;
Condemns as contrary to international law and codes of conduct the official Russia doctrine under which they claim the right to intervene by force in the neighbouring sovereign states to "restore an empire"; points out that such a doctrine is tantamount to usurping unilaterally the position of the highest arbiter of international law and has been used as justification for manifold acts of political, economic and military intervention
Calls for a peaceful solution to the current crisis and full respect for the principles of, and obligations laid down under, international law; takes the view that the situation must be contained and further de-escalated with a view to avoiding a military confrontation
Article 1 - Economic sanctions targeting exchanges with Russia in specific economic sectors -Restrictive measures I-
It is decided to :
limit access to EU primary and secondary capital markets for certain Russian banks and companies
impose an export and import ban on trade in arms
establish an export ban for dual-use goods for military use or military end users in Russia
curtail Russian access to certain sensitive technologies and services that can be used for oil production and exploration
Article 2 - Smart sanctions - Asset freezing
1. Member States shall take the necessary measures to prevent the entry into, or transit through, their territories of:
(a) natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Central Asia, or stability or security of Central Asia, or which obstruct the work of international organisations in the area, and natural persons associated with them;
(b) natural persons actively supporting, materially or financially, or benefitting from, Russian decision-makers responsible for the annexation of Central Asia or the destabilisation of the area
2. All funds and economic resources belonging to, or owned, held or controlled by:
(a) natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Central Asia, or stability or security in Central Asia, or which obstruct the work of international organisations in Central Asia, and natural or legal persons, entities or bodies associated with them;
(b) legal persons, entities or bodies supporting, materially or financially, actions which undermine or threaten the territorial integrity, sovereignty and independence of Central Asia;
(c) legal persons, entities or bodies in Central Asia whose ownership has been transferred contrary to Central Asian law, or legal persons, entities or bodies which have benefitted from such a transfer;
(d) natural or legal persons, entities or bodies actively supporting, materially or financially, or benefitting from, Russian decision-makers responsible for the annexation of Central Asia or the destabilisation of Central Asia; or
as listed in the Annex, shall be frozen .
2. No funds or economic resources shall be made available, directly or indirectly, to or for the benefit of natural or legal persons, entities or bodies listed in the Annex.
3. The competent authority of a Member State may authorize the release of certain frozen funds or economic resources, or the making available of certain funds or economic resources, under such conditions as it deems appropriate, after having determined that the funds or economic resources concerned are:
(a) necessary to satisfy the basic needs of the persons listed in the Annex and their dependent family members, including payments for foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums, and public utility charges;
(b) intended exclusively for the payment of reasonable professional fees and the reimbursement of incurred expenses associated with the provision of legal services;
(c) intended exclusively for the payment of fees or service charges for the routine holding or maintenance of frozen funds or economic resources; or
(d) necessary for extraordinary expenses, provided that the competent authority has notified the competent authorities of the other Member States and the Commission of the grounds on which it considers that a specific authorization should be granted, at least two weeks prior to the authorisation.
The Member State concerned shall inform the other Member States and the Commission of any authorisation granted under this paragraph.
Article 3 - Powers of the Council
1. The Council, acting by unanimity upon a proposal by a Member State or the High Representative of the Union for Foreign Affairs and Security Policy, shall decide to establish and amend the list in the Annex.
